Contest Rules "News"

INTRODUCTORY ​PROVISIONS

The promoter of the contest is ORLEN Unipetrol RPA, s.r.o.- Záluží 1, 436 01 Litvínov, Company ID No: 27597075, Tax ID No.: CZ699000139, entered in the Commercial Register at the Regional Court in Ústí nad Labem, File No. 24430 C (hereinafter referred to as the “Promoter”)

The subject of these Contest Rules is the regulation of the legal relationship between the contestant and the Promoter in relation to the "News" contest (hereinafter referred to as the "Contest Rules"). By entering the contest, the contestant agrees to these rules and undertakes to abide by them.

TERMS OF PARTICIPATION

In order to participate in the contest, you must meet the following conditions:

  • address for delivery in the Czech Republic

  • at least 18 years of age

  • subscription to the newsletter on the website https://www.ltai.cz/en/lp-contest-newsletter-signup, the successful completion of which is notified to the subscriber by a confirmation e-mail, sent to the email address submitted during subscribing to the newsletter

  • agreement to and compliance with these Contest Rules

The term of the contest is from 16 December 2022 (Friday) until 11:00 p.m. on ​2 January 2023 (Monday).

The contestant is authorised to enter the contest only once, through their own e-mail account on the website: https://www.ltai.cz/en/lp-contest-newsletter-signup. Employees of the Promoter and persons in a contractual relationship with the Promoter or any other companies from the ORLEN Unipetrol group are excluded from the contest.

THE CONTEST "NEWS" IS NOT A GAME OF CHANCE WITHIN THE MEANING OF ACT NO. 186/2016 COLL. ON GAMBLING, AS AMENDED. PARTICIPATION IN THE CONTEST IS NOT CONDITIONAL ON THE PURCHASE OF GOODS OR SERVICES, PAYMENT OF A BET OR ANY OTHER CONTRIBUTION TO THE CONTEST OR FULFILMENT.

CONTEST ​MECHANISM​ AND ​PRIZES

The winners will be selected by the Promoter.

The contest task is: Entering an existing e-mail in the banner field - “Subscribe to newsletter” on the website https://www.ltai.cz/en/lp-contest-newsletter-signup. The contest task must be completed in the required form and with the required parameters during the term of the contest.

Subsequently, a total of 8 winners will be selected according to the following ​mechanism:

On 3 January 2023, winners from all the contest participants will be announced. A winner will be:

  • each contestant who subscribes to the Czech newsletter database as the 10th, 20th, 30th and 40th in order; and

  • each contestant who subscribes to the English newsletter database as the 10th, 20th, 30th and 40th in order.

​The winner will receive a Let's Talk About It and ORLEN Unipetrol gift pack.

Within 2 working days of the end of the contest, the Promoter will contact the individual winners by email to the email address provided for the newsletter subscription and the winner will be asked to provide their contact details for sending the prize. By entering the contest, the contestant agrees to this method of communication in the event of winning.

  • If the winner does not respond within 48 hours of the winners being announced, the prize will be forfeited to the Promoter. The prize will also be forfeited to the Promoter if the identity of the winner (name, surname, email address, postal address for delivering the prize, preferred clothing size of the prize) is not sufficiently proven or if the winner is found to have breached these rules at any time prior to the prize being handed over. The prize will also be forfeited to the Promoter in case of an unsuccessful delivery.​

  • There is no legal entitlement to the prizes in this contest. Prizes cannot be cashed or claimed in exchange for other goods. In the case of delivery of prizes by ordinary mail or similar transport within the Czech Republic, the costs of delivery shall be borne by the Promoter.

  • If the prize cannot be delivered to the address provided by the winner for reasons on the winner’s side, the winner is obliged to reimburse the Promoter for the costs incurred for transport and packaging of the prize.

ORGANISER’S RESPONSIBILITY FOR THE CONTEST AND PERSONAL DATA PROTECTION

The Promoter reserves the right to make the final decision in all matters relating to the organisation and conduct of the contest, including any suspension, postponement, revocation or modification of the Contest Rules. The Promoter is authorised to change the Rules at any time during the contest, i.e. including the methods of determining the winners, the types of prizes, and in exceptional cases, to cancel the contest. The Promoter’s authority to intervene in the contest includes the Promoter’s right not to award a contest prize to a contestant if the Promoter suspects that the contestant has breached or attempted to breach the Contest Rules. In such cases, the Promoter is authorised to exclude the contestant from the contest without any compensation. The final decision on disputed issues always rests with the Promoter.

The prize from this contest cannot be transferred to another contestant or third party. The prizes cannot be paid out in cash or any other non-monetary compensation. The Promoter is also authorised to change the types of prizes at any time during the contest.

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter referred to as “GDPR”) and Act No. 110/2019 Coll., on personal data processing, the Promoter is the controller of the contestant’s personal data in the following scope: contact data (e-mail); as for the winners, the Promoter also processes: identification data (names, surnames), address data (delivery addresses) and additional data (clothing size).

The purpose of processing personal data is the implementation of the contractual relationship in the context of participation in the contest and the related legal claims in the event of fulfilling the conditions for receiving the prize (implementation and evaluation of the contest).

The legal basis for processing personal data is the performance of the contract, to which the contestant as the data subject is a party, or for the implementation of measures taken prior to the conclusion of the contract within the meaning of Article 6(1)(b) GDPR.

The provision of personal data is a necessary requirement for participation in the contest. Without providing personal data it is not possible to participate in the contest or for the Promoter to implement it.

The contest Promoter is authorised to transfer the contestant’s personal data to the extent necessary for the implementation and evaluation of the contest or the performance of other duties. The Promoter may transfer personal data to parties providing services for the operation of the contest and administration of the website, or to other technology suppliers.

The publisher also transmits personal data in the event of fulfilling a legal obligation (e.g. at the request of the Police of the Czech Republic) or when protecting its rights.

The transfer of personal data to third parties always takes place in accordance with the relevant legislation and in compliance with the highest standard of data protection, which ensures the proper preservation of the rights of data subjects and the protection of their privacy.

Personal data will not be transferred to countries outside the EU, the EEA or international organisations and will not be subject to automated decision-making.

The Promoter processes personal data only for the time necessary to achieve the relevant purpose, but no longer than for 2 (two) years from the start of the contest or for the period specified by the relevant legislation. It will erase the personal data after the retention period has expired.

In connection with personal data processing, the contestant has the following rights:

  • the right to access personal data;

  • the right to rectification;

  • the right to erasure;

  • the right to restriction of processing;

  • the right to object;

  • the right to data portability;

  • the right not to be subject to automated decision-making, including profiling;

  • the right to withdraw consent to the processing of personal data;

  • the right to lodge a complaint with the supervisory authority, which is the Office for Personal Data Protection.

The Promoter has appointed a data protection officer who is available to the contestant in the event of questions or irregularities with the processing of personal data or to exercise rights via the email address osobniudaje@orlenunipetrol.cz or the mailing address ORLEN Unipetrol RPA, s.r.o., Odbor ochrany informací, Milevská 2095/5, 140 00 Praha 4, the Czech Republic.

OTHER​ CONDITIONS

The Promoter reserves the right to change, cancel or otherwise modify the contest and prizes at any time during the contest. The Contest Rules may be amended or supplemented during the contest. The Promoter is not liable for any damages or any pecuniary or non-pecuniary loss caused by the preparation or performance of any acts of the contest, participation in the contest or winning the contest or in connection therewith. The Promoter is not liable for any loss, non-delivery, delay or damage to the prize in the event of transportation by post. The Promoter reserves the right to exclude a contestant and delete their entries at any time during the contest, without any compensation, if the contestant violates the terms and conditions set forth in these Rules or if their actions during the contest are contrary to the legitimate interests of the Promoter or other contestants, or are contrary to the law of the Czech Republic or good morals.
